Asbestos Siding on a New Jersey House: How to Tell, What the Rules Say, and Your Options (2026)
The Short Answer
Intact asbestos-cement siding is generally not the hazard people fear. The U.S. EPA says asbestos-containing materials that are not damaged or disturbed "are not likely to pose a health risk." Disturbing it is the problem: sawing, sanding, drilling, scraping or breaking it.
You cannot confirm asbestos by eye. The New Jersey Department of Health says a sample "must be analyzed by a laboratory that is accredited for analyzing asbestos."
You have five lawful options in New Jersey. Leave it and watch it. Paint it. Replace a few broken shingles. Cover it with new siding. Or have it removed. The same Health Department page says there is "no State requirement that the siding be removed before new siding is installed on the house."
General information, checked against the linked sources as of September 2026. It is not legal, medical or environmental advice. Nothing here says your house contains asbestos. Only a lab test confirms that.
Walk down almost any older block in Essex County and you will pass it. Flat, hard shingles about two feet wide. A faint wood grain pressed into the face. A straight or wavy bottom edge, nail heads showing, a chipped corner here and there. Usually painted three or four times since it went up.
Homeowners tend to learn what it might be at a bad moment. A home inspector writes it up. A painter will not quote the job. A salesman says it all has to come off. Most of what gets said in those moments is half right.
This guide sticks to what the agencies publish: the EPA, OSHA, the Consumer Product Safety Commission, and the New Jersey state agencies that share this subject. Every rule below links to its source, read in September 2026. Where the New Jersey sources do not answer a question, we say so and give you the number to call. The local reason it matters is simple. More than half of Essex County housing was built before 1960, which is the era this siding went up. The Census figures are further down.

Five Options, Side by Side
No law makes you tear it off. The Department of Health puts it plainly: "There are no state or federal laws that specifically require you to remove asbestos in your home just for the sake of getting rid of it." So the real question is which option fits the wall you have. The table is a summary. Each cell is sourced in the section that follows it.

One caution before you hire anyone. The Consumer Product Safety Commission puts it in writing: "There have been reports of firms incorrectly claiming that asbestos materials in homes must be replaced." If someone tells you the law requires a tear-off, ask which law.
What Asbestos Siding Looks Like, and How to Tell
Asbestos-cement siding is Portland cement reinforced with asbestos fiber, pressed into thin rigid shingles. A 1951 National Bureau of Standards report says the first shingles designed particularly for use as siding were made in 1932. A USDA Forest Service history of early siding and roofing says these products "remained popular until the 1970s" when the EPA began regulating asbestos-containing materials. That span covers a great deal of New Jersey housing.
What it typically looks like
- Size. The Forest Service says most shingles were "typically 12 by 24 inches." The Health Department also describes flat fiber-cement panels, usually 1/8 inch thick and 4 by 8 feet, and brittle.
- Nail holes. The shingles came drilled for nailing. You usually see nail heads near the bottom edge of each one.
- Surface. Siding from the 1920s and early 1930s was smooth. Wood-grain textures were available from 1937. Of the 23 samples the Bureau of Standards tested, 20 were wood-grained.
- Bottom edge. Straight, or the wavy edge that Sears, Roebuck helped introduce.
- Color. White, gray-pink and gray-green were most common. Speckled faces came in the 1940s. Deeper brown, green and coral followed in the 1950s. Many walls have been painted since.
- Feel and breaks. Thin, hard and brittle. The Forest Service notes a broken edge is usually gray inside, and the material sounds "almost like ceramic." InterNACHI lists chipping and cracking as the usual defects.
- The name. You may hear it called transite. Transite was a Johns-Manville trademark. The federal trademark record for "Flat Transite" covers asbestos cement sheets and wall panels. OSHA's rule now uses "transite panels" as a generic term.
Why looking is not enough
None of that is proof. Today's fiber-cement shingles are made to match the old ones and contain no asbestos. EPA says you generally cannot tell whether a material contains asbestos "simply by looking at it, unless it is labeled." The Health Department booklet adds that even an expert cannot give a definite answer until a sample is analyzed.
How a sample gets tested
- Decide whether you need a test at all. EPA says that if materials are not damaged and will not be disturbed, you do not need to have your home tested. Test before work that would disturb the wall.
- Have a trained person take the sample. EPA is direct: "Taking samples yourself is not recommended." Done wrong, sampling can be more hazardous than leaving the material alone.
- Know who that is in New Jersey. The state does not license asbestos inspectors. The Health Department recommends an inspector certified under the EPA program. If that is out of reach, it suggests asking an accredited lab how it wants a sample submitted.
- Use an accredited lab. The Health Department recommends labs accredited by the American Industrial Hygiene Association or by NVLAP at the National Institute of Standards and Technology. NIST keeps a searchable directory of accredited labs.
- Expect polarized light microscopy. The Health Department calls it the most common method for bulk samples. Under OSHA and New Jersey rules, material with more than 1 percent asbestos counts as asbestos-containing.
- Keep the tester separate from the fixer. EPA advises using two different firms, so the one that finds the problem is not the one paid to remove it.
Is Asbestos Siding Dangerous?
Asbestos is a known human carcinogen. That part is not in dispute. The Health Department ties it to lung cancer, mesothelioma and asbestosis, diseases that can appear 20 to 50 years after exposure. It also notes that risk generally depends on the length and intensity of exposure. People who die of these diseases have primarily had long-term occupational exposure.
What matters for a house is whether fibers get into the air. Siding is what the agencies call non-friable. The fibers are locked in cement. Here is how each agency puts it, as of September 2026:
- EPA: generally, material in good condition that will not be disturbed "will not release asbestos fibers."
- NJ Department of Health: "Asbestos siding is durable and generally not as hazardous as asbestos pipe or boiler insulation."
- CPSC: asbestos cement roofing, shingles and siding are not likely to release fibers unless they are sawed, drilled or cut. Its advice in capital letters is to leave material in good condition alone.
- The catch, from the Health Department: "if the material is abraded, sanded or sawed, the material can easily be rendered friable."
- Age counts too. The Forest Service notes these products can become friable if they are severely deteriorated.
For scale, the OSHA limit for workers is 0.1 fiber per cubic centimeter of air as an eight-hour average. That is a workplace limit, written for the people doing the disturbing. It is the reason the work practices later in this guide exist. If you have health questions about a past exposure, that is a conversation for your doctor, not a contractor.
Do not do this
- Do not "saw, sand, scrape, or drill holes in asbestos-containing materials." (EPA)
- Do not "dust, sweep, or vacuum debris that may contain asbestos." (EPA)
- Do not use a household vacuum on the dust, even one with a HEPA filter. (NJ Department of Health)
- Do not take your own samples if you can avoid it. (EPA)
- Do not break removed material into small pieces. (EPA)
- Do not hammer, saw or drop shingles during removal. (NJ Department of Health)
- Do not track debris through the house. Wet-mop it, or call an asbestos professional for a large area. (EPA)

Asbestos Roof Shingles
The same material went on roofs first. The CPSC list of places asbestos turns up in a house begins: "Some roofing and siding shingles are made of asbestos cement." The Forest Service history describes roof shingles in square, rectangular, diamond and scalloped shapes. By the 1920s they came in gray, red and blue-black to resemble tile and slate. On an old roof, from the sidewalk, they can pass for slate.
Asphalt roofing is a separate case. The Health Department booklet says asbestos roofing felt has been in use since about 1910. Older asphalt shingles and felts may contain asbestos as well. Again, only a lab test settles it.
What the rules say about roofs
- Licensing. The New Jersey exemption covers roofing as well as exterior siding, except in demolition. See the removal section.
- OSHA work practices. For employers, roofing material must be removed intact where feasible. Wet methods apply to material that is not intact. Cutting machines are misted.
- Getting it down. OSHA says removed material "shall not be dropped or thrown to the ground." It is passed down by hand or lowered by covered chute, crane or hoist.
- One carve-out. The OSHA standard does not apply to asbestos-containing asphalt roof coatings, cements and mastics.
- Disposal. NJDEP puts asphalt roofing products in a different waste category than asbestos-cement shingles. See the disposal section.
Asbestos-cement roof shingles are brittle. Foot traffic cracks them, and a cracked shingle is a disturbed one. That makes roof work on these houses a job for people who know the material. Option 1: Leave It and Keep It Sound
For a wall in good shape, this is what EPA, CPSC and the Health Department all recommend first. EPA says to keep an eye on the material and check it over time for wear or damage. On siding, that comes down to a walk around the house twice a year.
- Look for cracked, chipped or missing shingles.
- Look at the bottom courses, where mowers, shovels and bikes hit the wall.
- Look at nails. InterNACHI notes fasteners can fail before the siding does.
- Look for shingles that have slipped or hang loose.
- Look for white crystalline deposits or moss, which point to moisture.
- Keep shrubs or planting beds along the wall as a buffer. Both the Forest Service and InterNACHI suggest it.
EPA says slightly damaged material is sometimes best handled by limiting access and not touching it. More than slight damage is different. Then EPA calls for repair or removal by a trained and accredited asbestos professional.
Option 2: Painting Asbestos Siding
Painting is allowed, and it helps. The Health Department FAQ says that as an alternative to removal, "you can either paint or side over it." Its homeowner booklet goes further: "If siding shows signs of damage or wear, a coat of spray paint can help lock the fibers." InterNACHI adds that the material takes paint well because it is not porous like wood.
The risk is in the prep, not the paint. Everything a painter normally does to a tired wall is on the EPA list of things not to do.
- No sanding or dry scraping. EPA names both. The Health Department says sanding or abrading can make the material friable.
- No wire wheels, grinders or abrasive blasting. OSHA calls sanding, abrading and grinding "aggressive" methods.
- Go easy with water. New Jersey sources do not address pressure washing. One regulator that has, the Puget Sound Clean Air Agency in Washington State, allows it only at low pressure, without abrasives, and only if the siding is not disturbed. InterNACHI warns that a pressure washer can crack the siding.
- Wash by hand instead. The Forest Service suggests a cleaner in warm water, working from the bottom up and rinsing as you go.
- Deal with loose paint gently. If paint is peeling in sheets, that is a job to talk through with a trained professional before anyone scrapes.
- Do not paint over a failing wall. Paint will not hold crumbling shingles together. The Health Department booklet warns that coating badly deteriorated material can do more harm than good.
Option 3: Repairing a Few Broken Shingles
A baseball, a ladder or a fallen limb breaks two shingles. The rest of the wall is fine. This is the most common repair question, and the sources agree on the approach.
- Small cracks. The Forest Service says hairline cracks can be patched with clear epoxy, and larger gaps with a thin Portland cement grout.
- Broken shingles. The Forest Service says to replace them with "an alternative material, such as nonasbestos fiber-cement shingles." InterNACHI says damaged areas "can be replaced with non-asbestos fiber cement by a professional."
- The replacement product exists. One example is a fiber-cement shingle from GAF. Its product page reads: "Virtually identical in size and shape to many old asbestos siding shingles that are no longer available." The same page states that it contains no asbestos. We mention it as an example, not an endorsement.
- Who does it. EPA says it is "highly recommended that sampling and minor repair also be done by a trained and accredited asbestos professional." CPSC says the same, and defines minor as damage no bigger than your hand.
- What stays the same. The old shingle comes out whole if possible. Nothing gets cut or drilled to fit. The broken pieces are asbestos waste.

Option 4: Putting New Siding Over It
Can you put vinyl siding over asbestos siding? In New Jersey, yes. The Health Department answers it directly:
"Although some contractors insist on removing the siding before replacing it, there is no State requirement that the siding be removed before new siding is installed on the house. As an alternative, you can either paint or side over it. If you side over it, the new siding should be screwed in to avoid breakage of the asbestos-containing siding."

That is permission, not a blank check. Every fastener for the new siding goes through the old shingles. Here is what the sources say about doing it.
- The trade manual says call first. The Vinyl Siding Institute installation manual calls asbestos siding a regulated material. It says the environmental agency or local building official should be contacted before re-siding over it.
- Screws, not hammer blows. That is the Health Department instruction. The point is to avoid cracking shingles behind the new wall.
- Flattening the wall. The same manual says re-siding may need furring or removal of uneven original siding to get a smooth surface. Over this material, furring and foam board are the ways to get flat without removal. Each layer is fastened through the old shingles too.
- OSHA applies to the crew. The asbestos construction standard covers renovation of structures that contain asbestos. Ask how the crew fastens, and how it handles a shingle that breaks.
- Permits. New Jersey's construction code has a list of ordinary maintenance, which needs no permit. One entry reads: "The repair or replacement of existing siding on one- and two-family dwellings." Polypropylene siding is the stated exception. Confirm with your municipal construction office, especially in a historic district.
- Not every state agrees. Massachusetts regulators say covering is not prohibited but "not advisable." New Jersey takes the other view. We note it so you know the debate exists.
- It is still there. Covered siding is still on the house. Keep the test report. The next owner, and the next contractor, need to know.

Option 5: Removal, and Who May Do It in New Jersey
This is where most of the confusion lives, so we will go rule by rule. All of it is as of September 2026.
The New Jersey asbestos license
New Jersey licenses asbestos abatement contractors through the Department of Labor and Workforce Development. But the licensing chapter carves out this material. Under N.J.A.C. 12:120-1.4(b)5, the chapter does not apply to:
"The application, enclosure, encapsulation, repair, or removal of asbestos-containing roofing and exterior siding materials in all but demolition projects."
The Health Department says the same thing in plainer words: "In NJ it is not required that a NJ licensed asbestos contractor remove this type of material. The only exception is if the building is to be demolished." The exemption has been in the rule since 1989.
One state document reads differently. A 2013 Department of Community Affairs bulletin, written about demolishing storm-damaged homes, says anyone but the homeowner removing asbestos from a residence needs a Labor Department license. The regulation and the Health Department answer are the more specific sources for siding. If an official or a contractor tells you otherwise, call the Labor Department asbestos unit at (609) 633-3760. Ask them to point to the rule.
What still applies
- OSHA, for any employer. The standard defines Class II asbestos work to include removing "roofing and siding shingles."
- OSHA training. Workers who handle siding materials or transite panels need a hands-on course that "shall take at least 8 hours."
- OSHA work practices for siding. No cutting, abrading or breaking unless no safer method exists. Each shingle is sprayed with amended water before removal. Shingles are lowered by chute, crane or hoist, or bagged or wrapped by the end of the shift. Nails are cut with flat, sharp instruments.
- Disposal rules, for everyone. The 2013 bulletin is right on this point: the packaging and disposal procedures "apply to everyone, including the homeowner."
- Demolition. If the building is coming down, the exemption ends and a licensed asbestos contractor is required.
Federal rules on a single-family house
The federal asbestos air rule is called the NESHAP. EPA says it covers demolition and renovation of buildings, but it excludes "residential buildings that have four or fewer dwelling units." EPA also says federal law does not require people who remove asbestos from detached single-family homes to be trained and accredited. It still urges homeowners to hire workers who are. Houses demolished as part of a larger commercial or public project are treated differently.
Can an owner do it?
Legally, yes. The Health Department says "there are no regulations that forbid a homeowner from removing asbestos in their own home themselves, but we strongly advise against it." Its reasons are contamination of the house, the greater risk to children, and the equipment needed to control fibers. Its booklet is blunter: removal "is not a do-it-yourself project."
For whoever does the work, the Health Department describes the method. Shingles come off whole. Fastener areas are wetted first. Nail heads are cut rather than pulled through. Pieces are carried or lowered, never dropped. The ground is covered with plastic at least 6 mil thick. Doors and windows stay shut.
Questions to ask any contractor
- Has the siding been lab-tested, and may I see the report?
- Are you working under a New Jersey asbestos license, or under the roofing and siding exemption?
- What OSHA asbestos training has the crew on my job completed?
- How will shingles be wetted, removed and lowered?
- Who hauls the waste, and to which landfill?
- Will I get the disposal paperwork?
- What happens if shingles break during the work?

Disposal in New Jersey
Disposal belongs to the New Jersey Department of Environmental Protection. Its guidance document is the source for everything in this section.
- The waste type. ID 27A is "waste material consisting of asbestos or asbestos-containing waste."
- Houses are not exempt. Waste from a building with four or fewer units is outside the federal NESHAP, "but the material is still required to be managed and disposed of as ID 27A waste in New Jersey."
- Asphalt roofing is a separate category. Asphalt roofing products in good condition may go as construction debris, type ID 13C, or as ID 27A. Asbestos-cement shingles are not on that list.
- Keep it wet. NJDEP calls it prudent to keep suspect waste fully wetted until it is packaged.
- Package it. Bag or poly-wrap it. Pieces too large to bag go in a sealed bulk container with a liner "at least 6 mil thick."
- Hauling. "Registered New Jersey solid waste vehicles are required for the transportation of ACM and any solid waste containing asbestos." The load goes directly to a landfill or transfer station permitted to take it.
- Owner hauling. An individual may take properly packaged material to an authorized landfill in a vehicle with a "maximum gross vehicle weight of 9,000 pounds." Arrange it with the landfill first.
- Where it goes. NJDEP lists nine commercial landfills authorized for ID 27A waste. None is in Essex County, so hauling distance is part of any removal price here.
- Local rules. For a house, NJDEP recommends contacting "the county health department and/ or district waste management officials or the local township" to learn what local restrictions apply.
The New Jersey sources do not publish a step-by-step for a homeowner in Essex County. For that, start with the county health department, as NJDEP recommends. Health Department asbestos staff are at 609-826-4950.
Selling or Buying a New Jersey House That Has It
New Jersey does ask sellers about asbestos. The form is the Seller's Property Condition Disclosure Statement, set out in N.J.A.C. 13:45A-29.1. The Division of Consumer Affairs instruction sheet says that under P.L. 2024, c.32, "completion of questions 1 through 108 is mandatory for all sellers of residential real property in the State."
- Question 82 asks if you are aware whether the property has been tested for toxic substances "such as lead-based paint, urea-formaldehyde foam insulation, asbestos-containing materials, or others." It asks for a copy of each test report.
- Question 97 asks about material defects not disclosed elsewhere on the form.
- The standard is your knowledge. The form discloses the condition of the property "to the best of Seller's knowledge."
- A test creates knowledge. Once you hold a lab report, the answer to question 82 is yes, and the report gets attached.
- Nothing requires removal before a sale. The form asks questions. It does not order repairs.
If you are buying, expect your home inspector to flag the siding as possible asbestos-cement. The inspector cannot confirm it by eye either. A lab test during the inspection period gives you a fact instead of a guess. Then the five options in this guide are what you are pricing. What Drives the Cost
We are not going to print a price for asbestos siding removal in New Jersey. We could not find a current, citable third-party figure for this state. National averages hide the things that move the number here. The Health Department's own advice on estimates is: "Obtain numerous estimates, they can vary significantly." These are the drivers.
- Testing. A lab result comes first. Without one, every bidder prices the unknown.
- Which option. Painting, spot repair, covering and removal are four very different jobs.
- Wall area and height. A three-story house needs more staging than a cape.
- Condition. Sound shingles come off whole. Brittle, broken ones slow everything down.
- Access. Tight side yards, shared driveways and plantings all add labor.
- Disposal. Packaging, a registered hauler, landfill fees, and the drive to a landfill outside Essex County.
- What is underneath. Old clapboard, bare sheathing, or rot at the sills. Nobody knows until it is open.
- Trim and windows. Covering adds thickness. Removal exposes old trim. Either way the trim work is part of the job.
- Historic review. Some districts limit what can replace the original siding.

Why This Comes Up So Often in Essex County
The housing here is old. That is the whole explanation. The Census Bureau's American Community Survey, 2020-2024 five-year estimates, table DP04, counts 336,962 housing units in Essex County, New Jersey. By year built:

The same table puts New Jersey as a whole at 37.7 percent built before 1960. The United States is at 25.6 percent. Essex County has roughly twice the national share of pre-1960 housing. Nearly three in ten units here predate 1940.
Now set that beside the product history. Purpose-made siding shingles arrived in 1932 and stayed popular until the 1970s. They went on new houses. They also went over tired clapboard on older ones, since the Forest Service notes they were often applied over existing materials. A county where half the housing predates 1960 is a county where this siding is common.
That is a statement about the housing stock, not about your house. Plenty of old homes never had it. Plenty of look-alike shingles contain no asbestos. A lab test is the only thing that answers the question for one address.

Typical asbestos-cement siding is a thin, hard, brittle shingle about 12 by 24 inches, often with a pressed wood-grain face, a straight or wavy bottom edge, and factory-drilled nail holes. Original colors were mostly white, gray-pink and gray-green, and many walls have been painted since. None of that is proof. Modern fiber-cement shingles are made to look the same and contain no asbestos. The EPA and the New Jersey Department of Health both say only analysis by an accredited laboratory confirms asbestos.
Can you paint asbestos siding?
Yes. The New Jersey Department of Health lists painting as an alternative to removal, and its homeowner booklet says a coat of paint can help lock the fibers on worn siding. The limit is the prep. The EPA says not to saw, sand, scrape or drill asbestos-containing materials, so dry scraping, sanding and abrasive blasting are out. Wash gently, let the wall dry, prime and paint. If the shingles are crumbling or breaking apart, painting is the wrong fix and a trained professional should look at the wall.
Can you put vinyl siding over asbestos siding in NJ?
New Jersey allows it. The Department of Health says there is no State requirement that asbestos siding be removed before new siding is installed, and that new siding placed over it should be screwed in to avoid breaking the old shingles. The Vinyl Siding Institute installation manual tells installers to contact the environmental agency or local building official before re-siding over asbestos siding. Fastening still penetrates the old material, so for a contractor with employees OSHA's asbestos construction standard, 29 CFR 1926.1101, governs how that work is done.
Do you need a licensed asbestos contractor to remove asbestos siding in New Jersey?
Not under the state asbestos licensing rule, unless the building is being demolished. N.J.A.C. 12:120-1.4(b)5 says the asbestos license chapter does not apply to the application, enclosure, encapsulation, repair, or removal of asbestos-containing roofing and exterior siding materials in all but demolition projects. The Department of Health repeats that in its asbestos FAQ. Other rules still apply. OSHA classes siding removal as Class II asbestos work for employers, and the waste must be packaged and disposed of as asbestos waste under NJDEP rules. The Department of Health strongly advises homeowners against removing asbestos themselves. Confirm your situation with the Department of Labor at (609) 633-3760.
How do you dispose of asbestos siding in NJ?
NJDEP guidance says asbestos-containing waste from a home with four or fewer units is still managed and disposed of as solid waste type ID 27A. It should be kept wet, sealed in leak-tight packaging, and hauled by a registered solid waste transporter to a landfill authorized to take ID 27A waste. NJDEP lists nine such landfills, and none is in Essex County. A homeowner may haul properly packaged material personally in a vehicle under 9,000 pounds gross weight after arranging it with the landfill. Call your county health department first, and the NJ Department of Health asbestos staff at 609-826-4950 with questions.
Do I have to disclose asbestos siding when I sell a house in NJ?
New Jersey's Seller's Property Condition Disclosure Statement asks about it. Question 82 asks whether you are aware if the property has been tested for toxic substances such as lead-based paint, urea-formaldehyde foam insulation, asbestos-containing materials, or others, and asks you to attach any test report. Question 97 asks about known material defects not covered elsewhere. The Division of Consumer Affairs says completing questions 1 through 108 is mandatory for sellers of residential property under P.L. 2024, c.32. Nothing in the form requires removal before a sale. Ask your real estate attorney how to answer for your house.
Are asbestos roof shingles handled the same way as asbestos siding?
Mostly. Asbestos-cement roof shingles are the same kind of material, and the same advice applies: leave sound shingles alone and do not cut, drill or break them. New Jersey's asbestos license rule exempts roofing as well as exterior siding, except in demolition. OSHA has separate work practices for roofs. Material must be removed intact where feasible, kept wet if it is not intact, and lowered to the ground rather than dropped or thrown. Old asphalt roofing can also contain asbestos, and NJDEP treats asphalt roofing products as a separate waste category.
